These terms apply to your use of the BirdfolioSA mobile app and this website. By installing or using them you agree to these terms. If you do not agree, please do not use them.
1. About BirdfolioSA
BirdfolioSA is a photo checklist for Southern African bird photographers, operated by Francois Ubbink, trading as BirdfolioSA, South Africa. Contact: support@birdfoliosa.com.
2. Purchase
BirdfolioSA is a one-time purchase. You pay once through the Apple App Store or Google Play, and there is no subscription and no recurring charge. Payments, receipts and refunds are handled by Apple or Google under their own policies, and we do not receive your payment details. A purchase gives you a personal licence to use the app on your own devices, and it does not transfer ownership of the app or its content. Adobe Lightroom import needs your own Adobe account and Lightroom plan, which are paid to Adobe separately and are not part of this purchase.
3. Using the app
You may use the app for your own personal, non-commercial purposes. You agree not to misuse it, attempt to break or reverse-engineer its security, interfere with the Adobe login service, or use it in any unlawful way.
4. Your photos and content
Your photos and data belong to you. They are stored on your device, and we do not receive or claim any rights over them. You are responsible for having the right to use any photo you add, and for keeping your own backups.
5. Adobe Lightroom and other third-party services
The optional Lightroom import uses Adobe's services and requires your own Adobe account and a Lightroom plan with cloud sync. Your use of Adobe is governed by Adobe's own terms and privacy policy. Similarly, cloud storage providers you pick photos from or back up to are subject to their own terms. BirdfolioSA is not affiliated with or endorsed by Adobe, and we are not responsible for those services, their availability, or changes they make.
6. Species information
Species names and groupings are provided as a helpful reference based on published Southern African checklists. Taxonomy changes over time, and we do not guarantee that the list is complete, current or error-free.
7. Availability and changes
We may change, suspend or discontinue features, including Lightroom import, at any time, for example if Adobe changes its services. We do not promise the app will be uninterrupted or free of errors.
8. Disclaimer
The app is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. Because data is stored on your device, you are responsible for backing it up.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of photos, data or progress, arising from your use of the app or inability to use it. Nothing in these terms limits any rights you have under South African consumer law that cannot lawfully be excluded.
10. Intellectual property
The BirdfolioSA name, logo, design and code are ours or used with permission. Adobe and Lightroom are trademarks of Adobe Inc. You may not copy or reuse our branding or materials without permission.
11. Privacy
How we handle personal information is explained in our privacy policy.
12. Ending your use
You can stop using the app at any time by uninstalling it. We may suspend or end access if you break these terms.
13. Changes to these terms
We may update these terms from time to time. We will change the date above, and continued use after an update means you accept the new terms.
14. Severability
If any part of these terms is found unenforceable, the rest remains in effect.
15. Governing law
These terms are governed by the laws of the Republic of South Africa.
